The Pinel tax reduction is revoked when the rental commitment is not met. This includes a sale during the commitment period, a rental period interrupted for more than twelve months, or a child or parent who is a tenant joining your tax household. The transfer of ownership resulting from the death of one member of a couple filing jointly does not invalidate the reduction. When the conditions cease to be met during the commitment period, the tax for the year of the event is increased by the total of the reductions already obtained. In this case, the French tax authorities (BOFiP) set the date for the revocation no later than December 31st of the third year following the event.
This page describes the circumstances under which the Pinel scheme can be challenged and the recovery mechanism. It does not detail the exceptions provided for in the event of a sale or breach of the commitment: these are found in another document published by the BOFiP (Official Tax Bulletin), which must be read before making any decision. It does not provide the late payment interest rates or the relevant box numbers for the tax return.
What you need to know before talking about a takeover
The Pinel scheme has been closed to new investments since January 1, 2025. Existing investors retain the tax reduction if they meet the conditions. This is where the question of its potential reversal arises.
The investor has committed to renting the unfurnished property as the tenant's primary residence for a period of 6 or 9 years, at their discretion. The agreement is subject to review for breach of this commitment or the rental conditions.
The information pages for the scheme (service-public.fr, economie.gouv.fr) do not describe the recovery process. This information is found in the official tax guidelines, the BOFiP. The BOFiP's version addressing the Pinel scheme review is dated May 10, 2019. This page is based on that version and does not cover any more recent texts.
The cases of challenge described by the BOFiP
| Event | Effect described by the BOFiP |
|---|---|
| Rental agreement or conditions not respected | The reduction is being challenged. The exceptions refer to another BOFiP (BOI-IR-RICI-230-60), not detailed here. |
| Renting to an ascendant or descendant who belongs to your tax household, or who becomes part of it during the lease | The BOFiP (Official Bulletin of Public Finances) states that the tax reduction obtained would be subject to review. The condition is assessed in the year the lease is signed and each subsequent year of the tenancy. |
| Sale of the property during the rental commitment period | Reassessment. The applicable exceptions are those of non-compliance with the lease commitment (BOI-IR-RICI-230-60). |
| Joint ownership of the property, or transfer of rights by a co-owner during the commitment period | Reassessment. The BOFiP provides an exception for former spouses who took out the commitment during the marriage and remain in joint ownership after the divorce, within the framework of a joint ownership agreement: the remaining fraction can be retained. |
| Interruption of the lease for more than twelve months | The entire reduction will be reinstated for the year in which this twelve-month period expires. |
| Subscription of SCPI units not allocated within the 18-month period, or failure to comply with the SCPI's corporate purpose | Reassessment, without exception provided for by the BOFiP. |
This does not call into question the reduction
The death
If the transfer of ownership results from the death of one of the members subject to joint taxation, the BOFiP (French Official Tax Bulletin) states that the tax advantage is not affected. The surviving spouse who becomes only a co-owner (joint owner) cannot reclaim the advantage. Only the surviving spouse who is the beneficiary of the property, or the holder of its usufruct, can do so. The rights are assessed upon settlement of the estate.
The split of ownership resulting from a death
If the division of property rights results from the death of one spouse, the benefit acquired before the death is not affected. The surviving spouse, as the beneficiary or usufructuary, can benefit from the remaining portion.
Leaving for abroad
For investments made on or after January 1, 2019, the BOFiP (Official Bulletin of Public Finances) indicates that transferring tax residence outside of France does not invalidate the tax benefit. The taxpayer can continue to carry forward the tax reduction over the remaining tax years, against the tax assessed under the conditions of Article 197 A of the French General Tax Code (CGI). The reduction is not refundable. This rule applies if the taxpayer was domiciled in France at the time of the investment. For investments made before 2019, the rules are different; these can be found in the BOFiP.
How is the buyback calculated?
Two situations are described.
- The conditions were met initially, then cease during the engagement. Income tax for the year of the event is increased by the total amount of tax reductions obtained. According to the BOFiP (Official Bulletin of Public Finances), this reassessment occurs within the normal statute of limitations, i.e., no later than December 31st of the third year following the event.
- The conditions were not met from the outset. The tax due for the years in which the reduction was applied is increased by the amount of that reduction. The BOFiP (Official Bulletin of Public Finances) does not specify a deadline in this line of the table: the applicable date should be verified with the source.
The recovery is subject to late payment interest (Article 1727 of the French General Tax Code) and the penalty stipulated in Article 1758 A. In cases of deliberate omission or fraudulent maneuvers, the penalties stipulated in Article 1729 (a and c) also apply. No specific rates are provided here.
Numerical example (fictitious profile)
Situation. Marc and Sophie purchased a 50 m² apartment in 2024 for €250,000. They committed to a 9-year mortgage. For a 2024 purchase and a 9-year mortgage, the tax rate table on economie.gouv.fr indicates a rate of 12 %. This rate is an example only: this table does not differentiate between "Pinel+" properties, and the rate applicable to your property should be verified on the official website. They received four annual tax reduction installments before 2028 (hypothetical scenario).
Issue. In 2028, a career change leads them to consider selling. The commitment is still ongoing.
Strategy. Before signing, calculate the potential cost of the sale. Check if any exceptions in the BOFiP (Official Bulletin of Public Finances) apply to their situation. This point is addressed in the text, on a case-by-case basis.
Result.
| Step | Amount |
|---|---|
| Maximum price per m² (€5,500 x 50 m²) | €275,000 |
| Base amount used (lowest of €250,000, €275,000 and €300,000) | €250,000 |
| Total reduction (12 % of €250,000) | €30,000 |
| Annual fraction (one ninth) | €3,333.33 |
| Reductions already obtained (four fractions) | €13,333.33 |
If no exception applies, the 2028 tax is increased by €13,333.33, plus late payment interest and the surcharge under Article 1758 A. A sale during the commitment period falls under conditions that cease to be met; the BOFiP sets the date for the reassessment at the latest of December 31, 2031.
These profiles are fictitious. The price, area, rate of 12 %, and number of fractions obtained are assumptions. The calculation does not indicate whether the year of the event includes an extra fraction: this point is verified in the text. The figures illustrate the mechanism. They do not predict your situation.
What changes depending on your situation
- The nature of the event : sale, death, divorce, termination of lease, change of tenant.
- The moment : during or after the engagement period, year of the event, duration of the vacancy.
- The composition of the tax household : couple subject to joint taxation, child or parent tenant.
- Detention : directly, jointly, divided, or through SCPI units.
- The date of your investment : she orders the processing of a departure abroad.
- The exceptions : they are not detailed here and depend on the text applicable to your situation.
The rule depends on your case. No results are guaranteed.
Frequently asked questions
What happens if I sell my Pinel property before the end of the commitment period?
The BOFiP (Official Bulletin of Public Finances) treats the sale of a property for consideration during the commitment period as grounds for challenging the commitment. The applicable exceptions are those related to non-compliance with the lease commitment. These can be found in BOI-IR-RICI-230-60, prior to the sale.
Until what date can the administration resume the reduction?
When the conditions cease to be met during the commitment period, the BOFiP (Official Bulletin of Public Finances) indicates that the reassessment occurs within the normal recovery period, at the latest by December 31 of the third year following the event. For an event occurring in 2028, this would be December 31, 2031. When the conditions were not met from the outset, the BOFiP does not indicate a date in the corresponding line: the applicable date must be verified with the source.
Can I rent the accommodation to my child or my parent?
Yes, provided the tenant is not part of your tax household. This condition is assessed in the year the lease is signed and each year of the tenancy. If the tenant becomes part of your tax household, the BOFiP (French tax authority) states that the tax reduction obtained would be revoked.
Will my departure abroad cause me to lose the discount?
For investments made on or after January 1, 2019, the BOFiP (French Official Tax Bulletin) indicates that transferring your tax residence outside of France does not invalidate the tax reduction. You can continue to apply the reduction to your tax liability under the conditions of Article 197 A of the French General Tax Code (CGI). It is not refundable.
Can I still invest in Pinel?
No. The program has been closed since January 1, 2025.
