Returning from Mexico begins with a notification, even before arriving in France. Mexican federal tax law requires anyone ceasing residency to notify the tax authorities within 15 days prior to the change, and failure to notify allows the individual to retain Mexican residency status. The notification alone is insufficient; the new tax residency must also be proven. In France, the tax return for the year of return is split into two periods starting from the date of arrival, and Mexican bank accounts are declared using form 3916. This page does not cover the practical procedures of the Mexican tax authorities, the social security agreement with Mexico, or the French wealth tax (IFI) upon arrival.
Mexican side: prior notice
Article 9 of the Mexican Tax Code stipulates that individuals ceasing to be residents of Mexico must notify the tax authorities "a más tardar dentro de los 15 días inmediatos anteriores" (at least 15 days prior) of the change of residence. Failure to notify does not result in the individual losing their Mexican residency status. Nor does it result in the individual losing residency status if they fail to prove their new tax residency; the notification alone is insufficient. The same article also maintains Mexican residency when the new residency, even if proven, is located in a country where the income is subject to a preferential tax regime: for the fiscal year in which the notification is issued and the following five fiscal years. The definitions and exceptions are not detailed here.
The residency criterion in the same article is "casa habitación" (household residence), and, if there is accommodation in another country, the center of vital interests. The practical procedure (portal, form) has not been reviewed.
On the French side, the information sheet on service-public.gouv.fr regarding returning to France indicates that the tax clearance certificate is obtained from the tax authority of the country of residence being left. The sheet adds that any money transfer of at least €10,000 must be declared online to customs.
Your French tax residence upon return
According to the French tax authorities (BOFiP), meeting one of the criteria in Article 4 B is sufficient to establish residency in France: primary residence or home, primary professional activity, or center of economic interests. A stay of more than six months in the year is not an absolute requirement. If both countries consider you a resident for a period of time, the Franco-Mexican tax treaty determines residency based on permanent residence, center of vital interests, habitual residence, nationality, and then the amicable agreement of the authorities. Our page on the treaty details these criteria.
The year of return: two periods, two forms
The administration's page on returning from expatriation (published on June 25, 2026) distinguishes two cases for the declaration filed in the spring of the following year.
| Before your return | What you deposit |
|---|---|
| You had income from French sources | Form 2042-NR for your French-source income only during the period of non-residence, then form 2042 for your income from arrival until December 31st. |
| You had no income from French sources | No 2042-NR form: the 2042 form covers income received since your arrival |
Upon arrival, update your address in your online tax account. If you have no French-source income during your time abroad, form 2043, along with supporting documents, will adjust your withholding tax with the tax office at your new address. A balance under €300 will be deducted in a single payment; any amount exceeding this will be deducted in four monthly installments from September to December.
Year of return: numerical example (fictitious profile)
Situation. Inès, a fictional character, returns from Mexico and arrives in France on September 15, 2027. She is unemployed upon arrival. She is scheduled to start a new position in France on October 1, 2027; her last tax residence in France was in 2021.
Issue. She wants to know how her 2027 is structured, when her health insurance coverage can begin, and until when the expatriate scheme will run.
Strategy. It counts the days of each period from the date of arrival, adds three consecutive months of residence, then applies the rule of the five preceding calendar years and the eighth calendar year following that of the first taking office.
Result. From January 1 to September 14, 2027, 257 days fall under the non-residence period (form 2042-NR if there is French-source income). From September 15 to December 31, 108 days fall under form 2042. Approximately three months after arrival, i.e., from mid-December 2027, the residency requirement for health insurance could be met (calculation method to be confirmed with the CPAM). The five calendar years preceding the start of employment are 2022 to 2026, without tax residence in France: the requirement is met, and the scheme runs until December 31, 2035. With tax residence in France in 2023, it would not be met. The other conditions of the scheme are not examined, and this profile does not prejudge any actual situation.
Accounts and contracts opened in Mexico: form 3916
Bank accounts, capitalization contracts, or similar investments opened, held, used, or closed abroad during the year must be declared using form 3916 or 3916-bis. The return page extends the list to life insurance contracts and digital asset accounts. The fine is €1,500 per undeclared account. A further €10,000 applies to states or territories that have not signed an agreement with France on combating fraud (administrative assistance), and income may be presumed taxable with a surcharge of 40%. The pages reviewed do not specify which of the two fines applies to an account opened in Mexico: this point should be verified before filing.
Exit tax: the return as a tax relief event
If you left France subject to an exit tax, the instructions for form 2074-ETD (2025 transfer version) include "re-establishing your tax residence in France ("returning to France")" among the events triggering tax relief, if a deferral was granted, or a refund, otherwise. One condition is that you must still hold the relevant securities or receivables on the date of your return. If you do not return, the information sheet provides for tax relief after 2 years (total value less than €2.57 million) or 5 years (value above this amount) if the securities are retained.
Expatriate status: five calendar years outside of France
The regime under Article 155 B of the French General Tax Code (CGI), presented by the French Tax Administration (BOFiP) as a special regime for expatriate employees and executives, requires that the individual not have been tax resident in France for the five calendar years preceding their appointment to a company established in France. It runs until December 31st of the eighth calendar year following the year of their initial appointment. The expatriation bonus is generally exempt for its actual amount or, by option, assessed at 30% of total remuneration. The French Wealth Tax (IFI) is limited to assets located in France until December 31st of the fifth year following the establishment of tax residence. Individuals who come to work in France of their own volition are not eligible.
Health insurance: first hour worked or three months
For those returning from a country other than the European Union, the European Economic Area, Switzerland, and the United Kingdom, the information sheet on service-public.gouv.fr indicates that you are no longer covered by French social security, unless you have voluntary insurance. If you are employed, coverage applies from the first hour worked: form S1106 must be submitted to the CPAM (French Health Insurance Fund). Otherwise, you must have resided in France for three consecutive months before applying for universal health coverage. For retirees, eligibility depends on the existence of a social security agreement between the country they left and France. This page does not specify whether such an agreement exists with Mexico.
After your return: your belongings in Mexico
The convention distributes gains according to the nature of the asset. Gains on real estate located in Mexico, or on a company whose value derives more than 50% of its value from real estate in the 365 days preceding the transfer, are taxable in Mexico (Article 13, paragraphs 1 and 2). Other gains are taxable only in the state of residence of the transferor (paragraph 5). For a resident of France, Article 21, paragraph 1(a), grants a tax credit against French tax, capped for certain income at the corresponding French tax. The tax treatment imposed by Mexico on a former resident is not addressed here.
Returning from Mexico: what changes depending on your situation
- Your arrival date and your tax residence, as defined in Article 4 B and the convention.
- The fulfillment of the Mexican notice, and the fate of your accommodation in Mexico.
- Your French source income before your return, which determines the filing of a 2042-NR.
- A list of your accounts and contracts abroad.
- The existence of a deferred exit tax and the holding of securities upon return.
- Your professional situation upon arrival, for expatriates and health insurance.
The rule depends on your situation. No results are guaranteed.
