Form 2041-AS is not an income tax return. It is the tax residency certificate for Franco-Swiss cross-border workers. It has been mandatory since January 1, 2008. The employee completes it, has it stamped by the tax office in their place of residence, and then submits it to their Swiss employer upon hiring. Without this certificate, the employer automatically deducts Swiss tax at source.
This page describes form 2026 and its instructions: who it is for, its four sections, and the submission deadlines. It does not detail form 2047-SWITZERLAND or the boxes in declaration 2042, which are not reproduced on the official pages consulted.
Who is the 2041-AS intended for?
It applies to private sector employees working in one of the eight cantons covered by the 1983 border agreement (Vaud, Valais, Neuchâtel, Jura, Bern, Basel-Stadt, Basel-Landschaft, Solothurn). The tax administration's "Employees in Switzerland" page (updated 17/09/2026) places it in "case 1", with two conditions:
- «"You do not spend more than 45 nights a year in Switzerland for a full-time job"; ;
- «"The commute time between home and work should not exceed 3 hours per day (round trip).".
In this case, the Swiss salary is taxable in France. The system for the eight cantons is detailed on the sister page dedicated to the 1983 agreement. In Geneva and in the non-signatory cantons, a different system applies: this is not the subject of form 2041-AS.
The four sections of the form
The exact title is "Certificate of French tax residence for Franco-Swiss cross-border workers". Form 2026 (available online on the form page, updated on 08/08/2026) is structured as follows:
| Frame | Content | Who fills it |
|---|---|---|
| I | Relevant cantonal administration | The employee |
| II | Employee: identity, birth, profession | The employee |
| III | Employee declaration: work in Switzerland, employer, residence in France | The employee |
| IV | Certificate from the tax office | The tax office of your residence |
In section III, the employee undertakes to "notify their employer and the tax authorities of any changes concerning their tax residence." The tax authorities acknowledge this information "to the best of their knowledge.".
First year: four copies, to be submitted before the 1st day of the month
The instructions state that the employee must complete four copies (sections I, II, III). These must be submitted to the employer "before the 1st day of the month from which the benefit of the exemption" is requested.
For the visa, the tax administration website indicates that the online certificate must be validated by the individual tax office (SIP) of the applicant's tax residence. It directs users to the secure messaging system in their personal account on impots.gouv.fr. The validated certificate is then submitted to the Swiss employer "in a timely manner.".
Subsequent years: pre-filled certificate
For subsequent years, the instructions require attaching the annual salary certificate to the previous year's income tax return. A pre-filled certificate is then sent to the employee. This certificate must be given to the employer before January 1st of the year in question. The tax authorities refer to it as "2041-ASK" and link it to box "CASE 1" of appendix 2047-SWITZERLAND.
If the information on the pre-filled certificate "no longer corresponds to the employee's situation", the instructions require four new copies to be withdrawn.
The three-hour journey: presumption and evidence
The notice establishes the principle: "A round-trip commute of 3 hours is presumed to satisfy the principle of daily return travel as a general rule." Beyond this, "it is the taxpayer's responsibility to provide documented proof of the actual journey." The page "Employees in Switzerland" presents the same limit as a condition. The two texts are not reconciled here: for journeys exceeding 3 hours, contact the tax office before submitting the certificate.
The following is the certificate: contemporary advance payment and 2047-SWITZERLAND
According to the page "Am I a cross-border worker?", employers in Switzerland "cannot directly withhold French taxes at source." Cross-border workers therefore pay an advance, deducted monthly from the bank account they have provided to the tax authorities, and adjusted annually based on their most recent tax return. Employees must also complete form 2047-SWITZERLAND, checking the mandatory box "CASE 1". The instructions for form 2047 (income tax return for 2025) are intended for employees "working exclusively in the 8 cantons covered by the cross-border agreement" and refer them to form 2041-AS/ASK.
2041-AS: Calendar and route, numerical example (fictitious profile)
Situation. Camille lives in France and starts working in Delémont (Jura) on March 15, 2027, in the private sector. She spends 30 nights a year in Switzerland. Her commute is 1 hour 25 minutes each way. This is a fictitious profile. Assuming she applies for the exemption starting April 1, 2027, the first day of the month following her hiring. No source consulted supports this date choice, nor does it explain the rules for the period from March 15 to 31: this point should be verified with the tax authorities.
Issue. Submit form 2041-AS in time for the month from which the exemption is requested, in order to avoid the withholding of Swiss tax at source.
Strategy. Apply for the exemption from 01/04/2027, have the certificate endorsed, submit it before this date, then follow the schedule for the following years.
Result (CALCULATION).
| Item | Result |
|---|---|
| Overnight stays | 30, which is less than 45 |
| Round trip | 175 minutes, or 2 hours 55 minutes: below the 3-hour threshold |
| Exemption requested from | 01/04/2027 |
| Submission to the employer before the | 01/04/2027, or at the latest 31/03/2027 |
| Time between hiring and the last day | 16 days |
| The following pre-filled certificate must be submitted before the | 01/01/2028 |
If the journey had been 3 hours and 25 minutes, the presumption in the travel notice would not have applied, and documented proof would have been required. With 46 nights' stay, the tax authorities' website classifies the employee outside of case 1.
