The France-Kosovo tax treaty: a 1974 text maintained in 2013

Between France and Kosovo, the convention concluded with the former Yugoslavia on March 28, 1974, applies. An exchange of letters dated February 4 and 6, 2013, confirmed its continued application. It concerns only income tax. It caps withholding tax at 5% or 15% on dividends, and reserves interest and royalties for the beneficiary state.

A 1974 agreement, confirmed by an exchange of letters in 2013

The administrative list (BOI-ANNX-000306, dated April 29, 2016) cites, for Kosovo, the convention of March 28, 1974 (Official Journal of September 13, 1975) and the 2013 exchange of letters (Official Journal of April 26, 2013), and the "IR" category: neither wealth, nor inheritance, nor gift. It does not provide a BOFiP doctrine identifier for Kosovo. Decree No. 2013-349 of April 24, 2013, publishes the agreement signed in Paris on February 4, 2013, and in Pristina on February 6, 2013. In the French letter of February 4, 2013, France proposes "that the agreements listed in the annex to this letter continue to bind France and Kosovo"; the tax convention of March 28, 1974, is listed in point 12 of the annex. The agreement entered into force on 6 February 2013. Kosovo is not included in the list of conventions modified by the MLI (BOI-ANNX-000511, of 29 April 2026).
