For a mortgage, the French government's public service website states that the insurer is prohibited from requiring you to complete a health questionnaire if two conditions are met: the loan is €200,000 or less per insured person, and it must be repaid before you turn 60. Both conditions must be met. If only one condition is not met, you may be asked to complete a questionnaire.
This page deals with mortgage loans. It does not cover consumer credit, non-resident insurance, rates, or the legislation itself, which we have not reviewed directly. The sources used are those of the government, listed at the end of the page.
The rule at a glance
| Condition | Threshold, according to service-public | Key points to remember |
|---|---|---|
| Credit amount | €200,000 or less per insured person | A credit above the threshold opens the door to the questionnaire |
| End of refund | Before age 60 | Service-public refers to the age at which the repayment ends, not the age at which the contract is signed. |
| The two together | Cumulative | A small, very long-term loan is not enough, nor is a large, very short-term loan. |
The public service website dedicated to the Aeras agreement specifies that it is the total of all mortgage loans that are taken into account, with a fixed amount per borrower. If you have several loans, the method for combining them should be verified before signing.
The sources do not define the threshold in the same way: the public service website uses "or less" on one page and "less than or equal to" on the other, while the text of the parliamentary question refers to loans "less than €200,000". If your loan falls exactly at the threshold, the exact wording of the legislation should be verified before signing.
Where does the rule stand in 2026?
The public service websites that provide these thresholds were verified in 2025. A written question to the National Assembly (no. 14708, published in the Official Journal on April 28, 2026) requested that they be raised. The Ministry's response, published in the Official Journal on July 21, 2026, reiterates that these thresholds can be raised by decree of the Council of State, following an expert review by the Financial Sector Advisory Committee (CCSF) and the Prudential Control and Resolution Authority (ACPR). It does not set a timetable: the Government believes that more time is needed to assess the implementation of the law.
In short, the thresholds described on this page are those given by official sources at the time of review. No other thresholds are announced.
If you are above the thresholds
If either of the two thresholds is exceeded, the rule changes. Here's what the official sources say.
- A medical questionnaire. The insurer will have you fill it out before proposing a contract, and will assess the risk based on your answers.
- Good faith. The questionnaire must be completed in good faith. Omissions and intentional false statements are prohibited.
- No genetic questions. Questions about genetic characteristics are prohibited in the medical questionnaire.
- Four possible outcomes. After reviewing the questionnaire, service-public lists four decisions from the insurer: to insure you without any particular conditions, to insure you on the condition that you agree to pay an additional premium, to insure you while excluding risks related to the consequences of certain illnesses or events, or to refuse to insure you.
If your health is a concern: the Aeras agreement
If you have or have had an increased health risk, your application automatically falls under the Aeras agreement. This does not obligate the insurer to offer you a contract.
The procedure unfolds in stages:
- Level 1 : a general health questionnaire. If your health condition does not allow for a standard rate, the file moves to the next level.
- 2nd level : a questionnaire per pathology. A contract proposal is valid for 4 months.
- 3rd level This is only available if the loan being insured does not exceed €420,000 and if you will be under 71 years old at the end of the contract. According to the French government's public service website, the amount of a bridging loan is not included in this limit when the loan is financing the primary residence.
In the event of a refusal of insurance, credit institutions have committed to accepting alternative solutions. Service-public cites a assurance-vie policy already taken out, pledging a portfolio of securities to the bank, or a mortgage on a property different from the one to be financed.
The right to be forgotten
When you are asked to complete a questionnaire, the right to be forgotten applies to two illnesses: cancer and hepatitis C. You do not have to declare them if the treatment protocol was completed at least 5 years ago and there has been no relapse. Official sources do not describe in the same way any potential age requirement related to this right. Before waiving the right to declare an illness, this condition should be verified with the source.
Making mistakes in the questionnaire: what the sources say
Service-public describes the consequences of an inaccurate declaration:
- Intentional false statement : the insurer may request the cancellation of the contract in order to refuse to pay the capital or the annuity provided for (article L113-8 of the Insurance Code).
- A mistake due to negligence was discovered before a disaster. : the insurer can terminate the contract, or maintain it by applying an increase in the premium, with your agreement (article L113-9).
- A mistake due to negligence was discovered after a disaster. : the compensation may be reduced proportionally to the contributions that should have been paid (article L113-9).
Numerical example (fictitious profile)
Situation. Thomas, 43, is buying his primary residence. He is hesitating between three loan options. Assumptions of the fictional profile: Thomas is 43 years old at the time of signing, and loan terms and ages are expressed in whole years.
Issue. For which reason might a health questionnaire be requested?
Strategy. Check both conditions for each arrangement: amount of €200,000 or less, and end of repayment before age 60.
Result.
| Assembly A | Assembly B | Assembly C | |
|---|---|---|---|
| Amount | €190,000 | €260,000 | €190,000 |
| Term | 15 years | 20 years | 20 years |
| Age at the last due date | 58 years old | 63 years old | 63 years old |
| Difference from the €200,000 threshold | €10,000 below | €60,000 above | €10,000 below |
| Difference with the age of 60 | 2 years before | 3 years later | 3 years later |
| Health questionnaire | Forbidden | Possible | Possible |
Only option A meets both conditions. Option C remains under €200,000, but it ends at age 63: the questionnaire may be required. Option B combines both conditions.
This profile is fictitious. The calculation is limited to comparing two thresholds. It does not predict the price or the acceptance of your application.
What changes depending on your situation
- The amount of your project, and the number of credits you accumulate.
- Your age and the chosen duration, which determine the age at the final due date.
- Your state of health, which may involve the Aeras convention.
- Your situation abroad The sources consulted do not address loan insurance for non-residents. This page says nothing about it.
The rule depends on your situation. No results are guaranteed.
Frequently asked questions
At what income level can a health questionnaire be requested?
The government website Service-Public specifies a threshold of €200,000 or less per insured person, combined with repayment ending before age 60. Beyond these conditions, a questionnaire may be required. If your loan falls precisely at the threshold, the wording of the legislation is accurate, as different sources do not all use the same term.
My loan is less than €200,000 but ends at age 62. Am I affected?
Both conditions are cumulative. If the end of reimbursement occurs at age 60 or later, the questionnaire is no longer prohibited.
Can the threshold change?
The threshold can be raised by decree of the Council of State. In its response published on July 21, 2026, the ministry announced neither an increase nor a timetable.
Does a pre-existing cancer need to be declared?
When a questionnaire is requested, you do not have to declare cancer or hepatitis C if the treatment protocol was completed at least 5 years ago without relapse. The age requirement for this right is described differently depending on the official source; you should verify it with the source.
Who writes the response to the questionnaire?
You are the one who answers, in good faith. An inaccurate answer has consequences, described above.
