This depends primarily on the condominium bylaws. Bylaws established on or after November 21, 2024, must explicitly state whether furnished tourist rentals are permitted or prohibited. For older bylaws, a clause restricting the property to residential use only prohibits any professional activity, including furnished tourist rentals, according to service-public.fr. The landlord must also inform the building manager (see below).
This page deals with the regulations, informing the building manager, and the vote to prohibit certain activities. It does not cover numerical penalties, the declaration to the town hall, the registration number, or the case of regulations that are silent on the matter: these points should be verified with the town hall and the building manager.
Key points in a table
| Question | What official sources are saying |
|---|---|
| What should the regulations say? | Regulations established from 21/11/2024 must specify whether or not furnished tourist accommodations are permitted. |
| And a previous settlement? | A clause restricting the property to exclusively residential use prohibits any professional activity, including furnished tourist accommodation. |
| Should the building manager be notified? | Yes: the landlord must inform the building manager, who will then inform the co-owners at the next general meeting; the exact timing needs to be verified. |
| Can we vote for a ban? | In certain existing co-ownerships, a double majority representing at least two-thirds of the votes is required, rather than unanimity. |
| Tenant | Written agreement from the owner; prohibited in social housing |
What the regulations must say from November 21, 2024
The law of November 19, 2024, aimed at strengthening local regulations for furnished tourist accommodations, has changed the rules. Regulations established from November 21, 2024, explicitly state whether renting furnished tourist accommodations is permitted or prohibited (service-public.fr, information sheet on condominium regulations verified on July 8, 2026, and information sheet on classification verified on May 21, 2026).
The practical guide from the Ministry of Ecology adds a detail. When a new regulation prohibits these rentals, the prohibition applies to all rentals, including those of a primary residence for a limited period.
Before November 21, 2024: the bourgeois habitation clause
For a previous regulation, service-public.fr indicates that a clause restricting the use to residential purposes only prohibits any professional activity. The information sheet on the condominium regulations specifies that this clause prohibits carrying out any professional activity within the dwelling and cites short-term furnished rentals among the activities concerned.
The ministry's guide reminds us that the possibility of renting furnished tourist accommodation depends primarily on the content of the condominium regulations.
Cases where the bylaws are silent on this subject are not addressed on this page. In such cases, you should consult the bylaws with the building manager or legal counsel.
Inform the trustee
The owner of a furnished tourist rental must inform the building manager, who in turn informs the co-owners at the next general meeting (service-public.fr, fact sheet on renting a primary residence as furnished tourist accommodation, verified on May 21, 2026, and the Ministry's guide). The exact timing for informing the building manager should be verified with your local town hall and your building manager.
Banning furnished tourist accommodations: the two-thirds vote
According to the ministry's guide, in existing co-owned properties whose regulations already prohibit any commercial activity in units not designated for commercial use, rentals can be prohibited by a double majority of the members of the owners' association representing at least two-thirds of the votes. Previously, unanimity was required. A news item on service-public.fr from November 2024, updated in January 2025, describes the same change.
The same guide indicates that, for these existing co-owned properties, the prohibition does not apply to primary residences rented out occasionally, up to a limit of 90 to 120 days per year depending on the municipality. This rule is only found in this guide: verify it before relying on it. For the rental period of a primary residence, see the page dedicated to the 90 and 120-day limits.
What fact sheet F2589 says, and doesn't say: the service-public.fr fact sheet on condominium regulations doesn't specify which majority applies to adding or removing a tourist rental permit. It only reiterates that unanimity is still required to change the building's designated use.
Tenant and Neighborhood
A tenant in the private sector must obtain written consent from their landlord. Furnished tourist accommodation is prohibited in social housing. In co-owned properties, legal action remains possible for abnormal neighborhood disturbances (Ministry guide, § 2.4).
Furnished tourist accommodation in co-ownership: a numerical example (fictitious profile)
Situation. In a hypothetical Lyon condominium with 1,000 votes, the bylaws already prohibit any commercial activity in residential units. The owners of several units are proposing to ban tourist rentals. Units A, B, and C represent 310, 220, and 110 votes, respectively. Assumption: the calculation is based on the total number of votes in the condominium association (to be confirmed with the property manager).
Issue. Did the vote reach the two-thirds threshold?
Strategy. Calculate the threshold, then compare the favorable votes.
Result. Two-thirds of 1,000 votes equals 666.67, or 667 whole votes. Lots A, B, and C total 640 votes, or 64.0 %. 27 votes are missing. With 30 more votes, the total is 670, above the threshold. This calculation only considers the number of votes: a double majority also requires a majority of the union members, which the source does not specify. This profile is hypothetical, and the outcome of an actual vote depends on your assembly.
