In summary…

When an agreement exempts the salary of an employee of an international organization, that agreement may stipulate that the exempt salary is still taken into account when determining the tax rate on their other income. This is the case in the 2010 France-IOM agreement: salaries are exempt, but are included in the calculation of the tax rate applicable to other income. You should verify this in your organization's specific agreement.

Your salary is exempt from French tax. You also receive rent, interest, or dividends. Do you think these are taxed as if you had no salary?

Not necessarily. The mechanism is called the effective rate.

1. The principle of the effective rate

With an effective tax rate, exempt income is not taxed, but it is added to other income to calculate the rate. This rate is then applied only to taxable income.

The bill authorising the approval of the France–IOM agreement describes this mechanism: exempted salaries are still taken into account to set the rate applicable to the person's other income, which preserves the progressive nature of the tax.

2. What this means for your investments

An employee with a high tax-exempt salary and some investment income may therefore see that income taxed at a higher rate than expected. This should be considered before choosing a contract: the net return on an investment depends on the rate at which its income will be taxed.

Each organization's rules depend on its specific policy. Some policies may not specify an effective rate. Read yours.

3. Fictional example: Karim, tax-exempt salary and rent

Situation. Karim, an employee of an organization whose agreement stipulates an effective tax rate, receives a tax-exempt salary of €60,000 and €10,000 in French rent. These figures are fictitious.

Issue. He believes his rents will be taxed as if they were his only income.

Strategy. He checks in the agreement whether the exempt salary is taken into account to set the rate, and has his rents calculated using this method.

Result. His €10,000 in rental income is taxed at the rate that would apply to an income of €70,000, not at the rate of an income of €10,000: a difference known in advance, before buying a rental property. The tax is not calculated here.

This is an illustrative example; it does not reflect the situation of any particular client.
