In summary…
Online monitoring is judged on six points, not on the name of a software program: what it includes, the update date for each line, access security, available documents, the annual report and what you get back if you leave. From a legal standpoint, three obligations must be met: registration with the’ORIAS, the written statement of suitability, and information on commissions, at least once a year as long as they are received.
Balmont Conseil is a firm not independent In regulatory terms: he receives commissions on the contracts signed. His annual follow-up is free and can be done remotely.
You have a securities account, two life insurance policies, a retirement savings plan (PER), and a rental property. The question isn't "Is there an online space?", but rather: what information is available there, on what dates, who is responsible for it, and what documents should the advisor provide?
1. Six requirements for online tracking
| Requirement | Question to ask | Proof to be requested |
|---|---|---|
| Overview | Which accounts and contracts appear? Is each line automatically linked or entered manually? | Written list of lines covered and their power supply methods |
| Update | At what rate is each line updated? | Last updated date displayed on each line |
| Secure access | Two-factor authentication? Who else can open my account? | Written description of access and list of authorized persons |
| Documents | Where can I find the mission letter, the statement of suitability, and the reports? | Secure space and notification for each new document |
| Annual Report | Is a dated report submitted annually? | Document with the date of the appointment and a summary of the discussions |
| Exit | What do we get back if we leave? | Export your documents and data on request |
Account aggregation: ask for the provider's name
If the service automatically retrieves your bank account information, ask which provider does so. The ACPR (French Prudential Control and Resolution Authority) classifies account information as a payment service: a provider whose sole service is this must be registered with them. Ask for their name and status. For insurance contracts, also ask how they are updated: via a connection with the insurer or by data entry from your statements.
Secure access: two-factor authentication
The CNIL (page dated March 14, 2024) recommends prioritizing multi-factor authentication whenever possible, especially for connections from outside the network. It combines at least two categories from among what you know, what you own, and what you are. A customer area accessible via the internet falls into this category.
2. What the regulations require of your advisor
Status, remuneration and mission statement
The financial investment advisor (CIF) is registered with ORIAS and belongs to a professional association approved by the AMF. They must tell you if their advice is independent or not. The engagement letter outlines the terms of the advice and the advisor's remuneration. A non-independent advisor may be paid by the company managing the product; if they receive this remuneration over time, they must regularly verify that your investments remain appropriate for your situation (AMF).
Declaration of suitability and periodic review
According to the workshop that the AMF dedicated to CIFs in December 2023, the suitability statement is written, submitted before the transaction, The document includes the date and time of the consultation and indicates whether a periodic review is necessary. It can be made available in a secure area for the advisor, with notification to the client. If a periodic review is promised, the client is informed in advance, and it takes place. at least once a year ; The annual review is documented in a report (date, summary of discussions). In life insurance, the ACPR indicates that the reasons for the recommendation are set out in a statement of suitability (July 2018).
Annual information on commissions and costs
Article 325-16 of the AMF's general regulations requires investment advisors (CIFs) to apply Articles 314-13 to 314-20. Article 314-17 stipulates that, as long as commissions or benefits are received continuously, the service provider must inform each client individually of the actual amounts. at least once a year ; It also refers to Article 50 of Delegated Regulation (EU) 2017/565 for costs and charges. Request this statement, in euros, annually.
The insurer's annual statement
For life insurance, the insurer sends an annual statement detailing the performance of euro-denominated funds and unit-linked funds, as well as the fees charged on each unit-linked fund. According to ABE Infoservice (Bank of France), regulations do not mandate a specific deadline for sending this statement. This is yet another reason to ask your advisor for an update date for each contract. See the costs of a life insurance policy.
3. Check registration in five minutes
- Look for the advisor in the register of the’ORIAS : registration number, status, SIREN number (AMF).
- Check that the category corresponds to what it offers you: investment advice, or insurance brokerage.
- Ask for the name of his professional association, the document summarizing his status, and his mission statement.
- If in doubt, contact the AMF Savings Info Service: it indicates whether the person can legally advise you (AMF).
Specifically. Our ORIAS number is 13003497: check it in the register, just like any other practice. With us, annual monitoring is free and can be done remotely. See How to verify that an advisor is accredited and annual asset monitoring.
For the technician. AMF General Regulation, Articles 325-16 (reference to Articles 314-13 to 314-20, version in force since June 8, 2018) and 314-17 (version in force since February 8, 2020); Insurance Code, Article L. 521-4, I (written record of the client's requirements and needs, as cited by the ACPR).
Our position
The software matters less than the date and the report. A dashboard without an update date is an outdated snapshot, and an online space without an annual meeting is no substitute for advice. Before signing, demand in writing: the list of tracked items, the update frequency, the access method, the date and content of the annual report, and the annual amount of commissions received. Frequently asked questions
Does an online space replace the annual meeting?
No. The AMF describes the periodic review as a meeting at least annually, with a report. The online platform serves as the medium: it stores documents and dates, but it does not provide advice.
Does my advisor have to send me a report every year?
Several obligations exist, each with its own document: the report of the periodic review when promised, individual information on commissions received, and the insurer's annual statement for life insurance. Request that the engagement letter list these documents with their dates.
Is follow-up possible if I leave Lyon?
At Balmont Conseil, yes: annual follow-up is free and can be done remotely. The first consultation is free, either in Lyon or via videoconference.
Are you comparing the follow-up care provided by two firms?
