Leaving France for Portugal: NIF, tax address and residence from day one

In Portugal, tax residency can begin from the first day of arrival, without waiting until the 184th day: the year of arrival is treated in two periods. On the French side, departure does not terminate your tax residency as long as one of the three criteria of Article 4 B remains met, and your documents may trigger the exit tax. This page describes Portuguese tax procedures, the deferral of the exit tax according to the instructions and the 1971 convention. It does not cover the Portuguese tax scale, visa requirements, or the organization and timeframe for registering EU citizens, which are determined on the date of arrival.

Residence: the first day, the night, and the total of 183 days

The Portuguese IRS code (CIRS, article 16) notably retains a presence of more than 183 days, «seguidos or interpolados, em qualquer período de 12 meses com início ou fim no ano em causa», or the provision of accommodation «em conditions que façam supor intenção atual de a manter e ocupar como residência habitual». A day of presence is «qualquer dia, completo or parcial, que inclua dormida».

According to the administration's FAQ on partial residency, tax residency begins on the first day of presence if the 183-day requirement is met. The years of arrival and departure are treated as two separate periods:

  • During the residence period, Portuguese and foreign income is declared and subject to inclusion (Article 22 of the CIRS); ;
  • During the period of non-residence, the IRS only applies to income produced in Portugal (Article 15 of the CIRS).

The Franco-Portuguese convention calculates residency differently: for salaries, Article 16 refers to a stay not exceeding 183 days "during the tax year in question." Two systems for calculating residency days coexist: one under domestic law, the other under the convention. If both states consider you a resident, Article 4 determines the criteria: permanent home, center of vital interests, habitual residence, nationality, or mutual agreement. See our page on the tax residence in Portugal.

Tax identification number, address and certificate: what the Portuguese administration describes

ApproachWhat official sources are saying
NIFAny person, Portuguese or foreign, resident or non-resident, can apply for a taxpayer identification number (gov.pt, updated on 01.09.2026)
Documents and location of a non-resident's NIF (Tax Identification Number)Passport and, if the address is not included, proof of address abroad; online application (e-balcão) or by appointment at a Serviço de Finanças or a Loja do Cidadão (AT fact sheet, July 2025)
Tax representativeNot mandatory for obtaining a tax identification number (NIF). If a tax relationship subsequently arises, a representative must be appointed or electronic notifications must be subscribed to within 15 days; the information sheet describes this appointment or subscription as optional for residents of a European Union country, Norway, Iceland, or Liechtenstein (same information sheet).
Change of tax address60 days when the change involves going from non-resident to resident or vice versa, 15 days in other cases; for a Union citizen, passport and registration certificate (AT fact sheet, September 2026)

The AT fact sheet indicates that the registration certificate is issued by the Câmara Municipal of the area of residence; official sources consulted do not agree on the body, and the deadline for requesting it is not decided here: check with the Portuguese administration before submitting.

Exit tax: what the information leaflet says for leaving the European Union

The conditions are those of standard practice: six years of residence out of the ten preceding the transfer, and either at least 50% of the company's profits or shares with a total value of €800,000. The notice states "greater than €800,000," while the information sheet states "at least €800,000": the discrepancy is addressed in your file, as the text of Article 167 bis could not be consulted. The notice also states that the application for a stay of execution must be filed "within ninety days preceding the transfer," whereas the information sheet states "no later than 90 days before": these two formulations differ and should be verified with the source. Income tax is 12.8 % and social security contributions are 18.6 % for a departure in 2026, the rate of 12.8 % coming from the 2025 transfer notice.

Payment deferral is automatic in the first case outlined in the notice: transfer to a Member State of the European Union that is not non-cooperative within the meaning of Article 238-0 A of the French General Tax Code (CGI); for a non-EU country, the notice requires an administrative assistance agreement and a recovery assistance agreement. For Portugal, three interpretations should be considered:

QuestionSourceWhat she said
European Union?France Diplomacy (15/09/2026)«"Portugal being a member of the European Union"»
Non-cooperative state?Appendix to the 2027 Finance Bill11 states listed following the decree of 15/04/2026; Portugal is not among them
Administrative assistance agreement (a condition specific to non-EU states)?Same annexPortugal is among the states linked to France as of 01/09/2026

The decree of April 15, 2026, has not been read: the list is verified on the date of departure. Except for automatic deferment, the application must be submitted before the transfer, within a timeframe specified differently in the instructions and information sheet (see above). Form 2074-ETD is a paper declaration, filed the following year in the first case. The tax relief is granted after 2 years for securities under €2.57 million, and after 5 years for securities exceeding that amount, provided they are retained; returning to France may also qualify. See the... exit tax forms.

RNH: scheme maintained for registered members, IFICI in brief

Items 8 to 12 of Article 16 of the CIRS, which governed the Non-Habitual Resident (NHR) regime, are reported as revoked by Law No. 82/2023 of December 29; the note to Article 16 (Article 236, items 3 to 5 of this law) maintains their application to taxpayers already registered as NHRs until the expiration of the period. Article 58-A of the Tax Benefits Statute introduced the IFICI: a special rate of 20% on net income from categories A and B, for 10 consecutive years starting from the year of registration as a resident, for those who have not been a Portuguese resident in any of the five preceding years and who carry out one of the activities covered (research, certified startups, highly skilled professions, among others). The application must be submitted via the Finance Portal by January 15th of the following year, and the administration excludes those who have benefited from the RNH (Non-Habitual Resident) scheme. This summary is not a diagnosis: see IFICI in detail.

Your French accounts as seen from Portugal: Appendix J and form 3916

A Portuguese resident declares all his income, both in the country and abroad. Annex J is «específico para os rendimentos obtidos no estrangeiro», and its table 11 identifies «todas as contas de pósito ou de títulos abertas em entidades financeiras localizadas fora de Portugal»: a French account enters there.

On the French side, as long as you are domiciled in France, your accounts, assurance-vie policies, and digital asset accounts opened abroad must be declared on forms 3916 or 3916 bis; failure to do so incurs a €1,500 penalty per account. In the year of departure, form 2042 reports your income up to the date of departure, and form 2042-NR reports your French-source income thereafter.

1971 Convention: Rates and Tie-Breaking

Signed in Paris on 14/01/1971 and amended by an addendum of 25/08/2016, in force since 01/12/2017, it caps withholding taxes.

Interest (art. 12)At most 12 %; 10 % for interest on bonds issued in France after January 1, 1965
Wages (art. 16)Only the state of residence, if the stay is no more than 183 days in the tax year and two other conditions apply.
Pensions (art. 19, art. 20 § 2)Private: State of residence; public: in principle the paying state
Double taxation (art. 24)France: exemption in principle, tax credit for certain income; Portugal: deduction from French tax, up to certain limits.

The page France-Portugal tax treaty resumes the articles.

Inheritance and gifts: what the 1994 agreement says

Inheritance and gifts are governed by a separate agreement, signed in Lisbon on June 3, 1994. This agreement extends to the other state the exemptions that one state grants to itself or its local authorities, and, reciprocally, to public bodies with scientific, cultural, educational, or charitable missions. The text read does not contain any rules governing the allocation of taxing rights between the two states.

An executive who moves to Lisbon on September 1, 2027: a numerical example (fictitious profile)

Situation. A fictitious executive arrives in Lisbon on September 1, 2027, with a net income of €100,000 per year (category A). His position is assumed to be in an activity covered by the IFICI (French tax on real estate investment trusts), and he has not been a resident of Portugal in any of the previous five years.

Issue. He wants to know from when he is a resident, what tax the special rate would produce and until what year it runs.

Strategy. He tracks his presence night by night, obtains his NIF, changes his tax address within 60 days and submits his registration application before January 15, 2028.

Result. From September 1st to December 31st, 2027, he has 122 days of residence. Residency begins on the first day if the 183-day requirement is met over 12 months. At 20 %, €100,000 of net income generates €20,000 for ten consecutive years, from 2027 to 2036. Eligibility is verified by document submission.

What changes depending on your situation

  • The criterion that maintains your residence in France.
  • The arrival date and the count of your nights over twelve months.
  • The value of your securities and the list of non-cooperative states as of the departure date.
  • Your potential eligibility for IFICI and its timeline.

No result is guaranteed in advance: each point must be read in light of the documents in your file.

Frequently asked questions

Do you need a tax representative to obtain a NIF?

No, for the allocation of a non-resident's NIF, according to the July 2025 fact sheet. If a tax relationship subsequently arises, the designation or adherence to notifications takes place within 15 days, but the fact sheet describes it as optional for residents of a country in the European Union, Norway, Iceland or Liechtenstein.

How soon can I change my tax address?

60 days when the change goes from non-resident to resident, 15 days in other cases, according to the administration's information sheet.

Is the deferral of the exit tax automatic?

In the case described above, the notice grants it automatically. Check the list on the date of departure; otherwise, the request must be submitted before the transfer, the notice ("within ninety days preceding the transfer") and the form ("no later than 90 days before") stating the deadline differently: check with the source.
