In summary…
There is no general exemption for international civil servants in France. The tax authorities state that remuneration paid by an intergovernmental organization is taxable in France if you are a tax resident there, and that exemptions exist only in treaties ratified by France. Therefore, you must consult the treaty or headquarters agreement of your organization.
You are recruited by an international organization based in France, or you live there while working for them. You are told that "international civil servants do not pay taxes." For some organizations this is true, for others it is not.
Here is the published rule, an example of an actual agreement, and the method to know where you stand.
1. The rule published by the tax authorities
Its page dedicated to agents of international organizations and European institutions indicates three points:
- Remuneration paid by an intergovernmental organization is taxable in France if you have your tax residence there, and is declared according to the rules for salaries and wages.
- Exemptions exist only in specific treaties ratified by France. Each text must be verified.
- Your salary is generally subject to tax deducted by the organization that pays you. The human resources department provides the details.
2. A real-world example: the France–IOM agreement
The International Organization for Migration (IOM) demonstrates how an exemption is structured. An exchange of letters signed in Geneva on October 15, 2010, stipulates that salaries paid by the IOM are exempt from French income tax for two categories of individuals: staff members who live in France and work at the Geneva headquarters, and non-French staff members who work in IOM offices in France. These salaries remain subject to the organization's internal tax.
The Senate adopted the approval of this agreement on March 19, 2015. The text excludes French nationals recruited locally in French offices: for them, common law continues to apply.
3. How to know where you stand
- Identify the treaty or headquarters agreement that governs your organization.
- Read what he says about salaries, your nationality, and your place of work.
- Ask your human resources department for the internal tax deducted and a receipt.
- Keep your contract or letter of appointment: the administration requires the duration, category, grade and step.
4. Fictional example: Hélène, an agent for an organization in Paris
Situation. Hélène, a French national, is recruited locally by an intergovernmental organization based in Paris. Her entourage assures her that she is exempt.
Issue. She doesn't know if the exemption applies to her nationality and place of work.
Strategy. She obtains the text that governs her organization and has her staff category confirmed in writing.
Result. Having read the text and having a certificate in hand before her first declaration, she knows whether her treatment is declared or not, instead of assuming it.
This is an illustrative example; it does not reflect the situation of any particular client.
Frequently asked questions
Do European Union agents follow the same rule?
No. They fall under Protocol No. 7. See the article on the tax residence of Union agents.
Is the organization's internal tax sufficient?
It depends on the applicable legislation. Where an exemption exists, the treatment is subject only to domestic tax. In other cases, the treatment must be declared in France.
Are my other sources of income covered by the exemption?
The France-IOM agreement, for example, exempts salaries and leaves other income outside its scope. Each text should be read. See the article on the effective rate.
