An employee of the Union who is stationed in a Member State for official purposes and then moves to another Member State for personal reasons retains their original tax residence. The State where they now reside cannot assign them a second tax residence.

A donation received by an employee of the European Union can be taxed by the state where they reside. The Court of Justice has just ruled on the conditions under which this is not possible.

This article is based on the Court's official press release; the full text of the judgment is authoritative.

1. The facts of the case

The dispute originated with the Bundesfinanzhof, the German Federal Finance Court. An employee of the European Investment Bank had left Austria for Luxembourg in 1995, then moved to Germany in 2010 while maintaining an apartment in Luxembourg. In 2013, his brother, who resided in Austria, made him a cash gift. Germany taxed this gift, considering that the employee also had a residence in Germany.

2. What the Court decides

Article 13 of Protocol No. 7 applies to gift taxes.

An agent installed for his duties who subsequently moves to another Member State for personal reasons retains his original residence.

Residence is independent of tax domicile. Living in a state does not create an additional tax domicile for the individual.

Excluding donations would create two residences and would allow the inheritance tax of the state of origin to be circumvented.

The Court leaves it to the German judge to decide the dispute himself. His interpretation is binding on other national courts.

3. What this changes for a French agent

For an agent whose country of origin is France, the ruling confirms the logic described in the article on article 13 The original residence follows the individual, even beyond their initial place of residence. In practical terms, if you receive a gift or inheritance while living in another Member State, you have a legal argument, as established by the Court, against taxation by the State of residence.

The Court does not say how France taxes the donation received: this step is settled with French law and applicable conventions.

4. Fictional example: Mathieu and his brother's donation

Situation. Mathieu, a French Union agent, was recruited in 2012 and assigned to Brussels. In 2019, the family moved to Luxembourg for personal reasons. In 2026, his brother, who lives in France, gave him a sum of money.

Issue. The administration of the state where he lives could consider him as domiciled in its territory and tax the donation accordingly.

Strategy. Mathieu gathers the documents that establish his chain of residence: address in France before 2012, employment contract, certificate from his institution, dates of address changes. He prepares to invoke Article 13 and the ruling of October 15, 2026.

Result. Only one tax domicile to defend, France, instead of two states claiming the same donation.

This is an illustrative example; it does not reflect the situation of any particular client.

5. Documents to keep

Your employment contract and its date.

Proof of your tax residence at that time.

Each change of address since then, with its reason.

A certificate from your institution regarding your agent category.

Frequently asked questions

Does the ruling also cover inheritances?

The text of the Protocol expressly mentions inheritance rights. The Court has ruled that the rule also applies to gifts.

Does the ruling apply only to agents of the European Investment Bank?

The case concerned an EIB employee. The reasoning is based on Article 13 of the Protocol, which applies to Union employees in the categories defined by regulation. Check your category with your institution.

Should I make a donation before or after moving?

This issue is resolved on a case-by-case basis. It is addressed in light of your original situation, the legislation of the recipient's state, and the value transferred.

Are you preparing a donation or are you receiving one?

We first look at your tax residence as defined in Article 13, then at the most suitable vehicle: donation, life insurance, dismemberment.

Are you a tax lawyer, notary, or chartered accountant, and do some of your clients work for a European institution? We can work in partnership on the investment and life insurance aspects, in conjunction with your tax analysis.

Book an appointment

A 30-minute exchange is enough to lay out your situation. Book a time slot.

Alexis Sagnier, financial and real estate investment advisor, insurance broker, AMF certified.
