Dependent children are covered in the same way. As soon as the spouse begins to work, they are no longer eligible for this rule, and their situation is governed by different rules.

Your spouse has followed you to Brussels or Luxembourg. They maintain an address in France for their parents or for property. Are they also a tax resident of France?

The answer is in the text of article 13, and it depends on a single criterion: his professional activity.

1. What the text says about the spouse and children

Article 13 (formerly Article 14) of Protocol No. 7 stipulates that the rule of retained domicile also applies to the employee's spouse, if they do not have their own professional activity, and to their dependent children. The result is the same as for the employee: the same original tax domicile for income tax, wealth tax, and inheritance tax.

2. What does "without independent professional activity" mean?«

The text uses a simple formula and does not specify an income threshold in the sources we consulted. A spouse who is employed, even part-time, or who is self-employed, has their own professional activity. A spouse who stays home does not.

For borderline situations (very short-term contract, secondary activity, voluntary work), the text does not provide an answer: the question should be addressed to your tax office with the documents in the file.

3. Cases not covered by the text

Two spouses who are Union agents with different states of origin. We found no published rule on this point in the official sources consulted. Each country of origin and the applicable tax treaties must be analyzed.

A civil union partner or a cohabiting partner. The text refers to "spouse". We found no clarification regarding other forms of union in the official sources consulted.

A spouse who returns to work. He no longer benefits from the rule once he engages in his own activity.

4. Fictional example: Julien and Sophie

Situation. Julien, a French national employed by the Union, moves to Brussels with his unemployed wife Sophie and their two children. They keep an apartment in Annecy.

Issue. Sophie was hired by a Belgian company eighteen months later. The family wondered if her change of circumstances affected their taxes.

Strategy. They note Sophie's start date, ask the administration how to handle her case and separate in their declaration what relates to Julien (maintained residence) from what relates to Sophie (own activity).

Result. One household, two situations to examine instead of one: that of Julien, who keeps his home in France, and that of Sophie, who deviates from the rule as soon as she takes up her post.

This is an illustrative example; it does not reflect the situation of any particular client.

5. What this changes for the couple's assets

If the spouses' residences differ, their joint assets and contracts must be considered separately: who owns what, in which country, and under which matrimonial property regime. For a life insurance policy, the designation of the policyholder and beneficiary is important. See Luxembourg life insurance and Union agents.

Frequently asked questions

Are adult children covered?

The text refers to dependent children. A child who has become independent no longer falls into this category.

Does my spouse need to remain registered in France?

The text is based on tax domicile, not administrative registration. This is proven by the documents in your file: date of commencement of duties, original address, household situation.

What is the starting point of the rule?

The tax residence "at the time of taking office" of the agent. See the article on article 13.

Does your household have two different situations?

We map each person's assets, what is owned and where, before proposing the distribution between contracts.

Are you a tax lawyer, notary, or chartered accountant, and do some of your clients work for a European institution?
