This applies to income tax, wealth tax, and inheritance tax. Your salary, however, remains subject to EU tax.

You work for the Commission, Parliament, Council, Court of Justice, or another EU institution in Brussels, Luxembourg, or Strasbourg. Your bank, your neighbor, or a colleague tells you that you are a "Belgian resident" or a "Luxembourg resident," and therefore taxable there on your assets. For most of the people concerned, the rule is written in a specific document, and it goes the other way.

Here is what this text says, under what conditions it applies, and what you need to do to ensure your assets are organized accordingly.

1. What Article 13 of Protocol No. 7 says

Protocol No. 7 on the Privileges and Immunities of the Union is annexed to the Treaties. Article 13 thereof (current numbering, formerly Article 14) provides that officials and other agents of the Union who take up residence in another Member State solely for the purpose of their duties are deemed to have retained the tax residence they had at the time they took up their duties, if that State is a Member of the Union.

This retained domicile is valid for income tax, wealth tax, inheritance tax, and the application of tax treaties. The legislation extends this rule to spouses who do not have their own professional activity and to dependent children. Movable property located in the host country is exempt from inheritance tax in that country. Domicilies acquired solely in the service of other international organizations are not taken into account.

For an agent of French nationality domiciled in France before their recruitment, this means: tax domicile in France, even with an address in Brussels or Luxembourg.

2. The conditions to be checked one by one

The country of origin is a member of the Union. For you, it's France.

You have changed Member States. The text concerns relocation to a Member State other than the one where you were tax resident when you took up your post. For a position outside the Union, the situation is handled differently, on a case-by-case basis.

The change comes solely from your roles. It is the initial installation that must be explained by your position. The Court of Justice clarified, in a judgment of 15 October 2026, what happens if you subsequently move for personal reasons: see the article on the ruling of October 15, 2026.

You belong to the categories of agents targeted. The Protocol refers to a regulation to define these categories, the names of which are communicated to governments (Article 15). The precise status (civil servant, temporary agent, contract agent) should be verified with your institution. See status and tax.

3. What this changes for your assets

Your tax residence determines who taxes you on what. If your residence remains in France, the French tax authorities indicate that social security contributions apply to your investment and property income. For your other French-source income, they differentiate between whether you lived abroad or in France when you first moved there: the non-resident regime applies in the former case, and the resident regime in the latter.

Three practical consequences to remember:

Any account or contract opened abroad must be declared annually. Details are in the article on income tax returns

Owning a house or apartment abroad raises questions regarding real estate wealth tax. See the five questions before signing.

4. Fictional example: Claire, recruited by the Commission

Situation. Claire, a French national, lives in Lyon. She is recruited by the Commission and moves to Brussels solely for this position. She retains a rental apartment in Lyon and a life insurance policy.

Issue. Her Belgian bank classifies her as a "Belgian resident" and asks her to disclose her investments as such. She doesn't know in which country to declare her rental income and her contract.

Strategy. She relies on Article 13 of Protocol No. 7, has her category of agent confirmed by her institution, and gathers her supporting documents: date of entry into duties, address before recruitment, employment contract.

Result. A single tax residence, France, is used for income tax, real estate wealth tax, and inheritance tax. A single point of contact handles all aspects of your case.

This is an illustrative example; it does not reflect the situation of any particular client.

5. Documents to request from your institution

Request written confirmation of your employee category and start date. Also, keep proof of your address in France before recruitment. These documents will allow you to explain your situation to a bank, insurance company, or tax office without having to repeat the explanation each time.

Frequently asked questions

Is my spouse subject to the same rule?

The text extends the right to retain the family home to the spouse without their own professional activity and to dependent children. The case of the spouse who works or is themselves an employee is addressed in the article about the spouse.

What if my job is located outside the Union?

Article 13 concerns establishment in the territory of another Member State. For a delegation or post outside the Union, you must consult the applicable tax treaty and your specific case.

Is my treatment mandatory in France?

No. Article 12 of the Protocol stipulates that salaries paid by the Union are subject to a tax for the benefit of the Union and exempt from the corresponding national taxes. Only your other income falls under the tax jurisdiction of your residence.

Does a Luxembourg life insurance contract change my tax residence?

No. Your domicile is determined by your situation, not by your investments. However, it does determine how the contract is declared and taxed.

Are you a civil servant or an employee of the Union?

For almost 14 years, we have been assisting expatriates and international families with their investments. We start with your status, your country of origin and your institution, then we build the allocation and contracts that are tailored to it.

Are you a tax lawyer, notary, or chartered accountant, and do some of your clients work for a European institution?
