A Luxembourg contract does not exempt you from French tax: a French tax resident declares their gains in France and retains the annual allowance after eight years, granted "under the same conditions" as with a French contract. What truly changes is the insurer and its regulator, the bank that holds the assets, and the annual declaration of the foreign contract, with a penalty of €1,500 per omitted contract.

Balmont Conseil is a firm not independent In regulatory terms: it receives commissions on the contracts underwritten. For Luxembourg life insurance, our entry fees are 0.5 %. First consultation free, in Lyon or via videoconference.

A resident of the Lyon region receives three Luxembourg employment contracts. None of them clearly states who is paid, with what money, or what will need to be declared annually. These details are what make the difference, even more so than the contract name.

1. What you require from the intermediary

An ORIAS number, and the correct category

To operate, an insurance intermediary must be registered with the register maintained by ORIAS. insurance broker is mandated by their client and is not required to work exclusively with one or more insurers. Since April 1, 2022, brokers must also join a professional association approved by the ACPR (French Prudential Control and Resolution Authority) to be registered. Minimum guarantees are set: professional liability insurance of at least €1,500,000 per claim and €2,000,000 per year, and a financial guarantee of at least €115,000.

Several contracts, and a level of written advice

«We have access to numerous contracts» says nothing about the advice. The ACPR (French Prudential Control and Resolution Authority) distinguishes three levels. Level 1, mandatory, consists of proposing a contract that aligns with your needs and requirements. Level 2, optional, consists of recommending the contract that best meets those needs. Level 3 is based on «an impartial analysis of a sufficient number of contracts offered on the market.» Ask which level your contact person works at. We work with 23 partner companies and asset management firms and have no capital ties with any bank or insurer.

What you are asking

What is fixed

Where to check it

ORIAS number and category "insurance broker"«

Registration is mandatory to practice

ORIAS register, which you can consult.

Professional association approved by the ACPR

Mandatory for brokers since April 1, 2022

Membership certificate

Professional liability insurance and financial guarantee

€1,500,000 per claim and €2,000,000 per year; at least €115,000

Intermediary's statements

Advice level (1, 2 or 3)

Level 1 is mandatory; levels 2 and 3 are optional.

Written document submitted before signing

Specifically. Our ORIAS number is 13003497: check it in the register, as you would for any intermediary. What really changes with a Luxembourg contract

Protection: an insurer regulated in Luxembourg, assets held in a bank

The Luxembourg insurer is regulated by the Insurance Commission (CAA). According to a CAA circular, the assets covering the insurer's liabilities are deposited with a custodian bank and recorded in a permanent inventory; they are allocated as a priority to the payment of insurance claims, and this priority takes precedence over all others. As of July 1, 2026, according to the CAA, 27 Luxembourg life insurance companies were operating in France under the freedom to provide services, and 5 per establishment (role of the CAA).

Access: dedicated fund or specialized insurance fund

CAA Circular Letter 26/1, applicable to contracts issued since February 1, 2026, sets two useful thresholds. One dedicated fund is only eligible for a contract with a minimum premium at the time of subscription of €125,000. specialized insurance fund is eligible "without any bonus or wealth requirements".

Taxation: that of a resident of France

For a French tax resident, the proceeds of a contract taken out with an insurer established outside France are taxable in France, under the category of foreign securities. The annual allowance of €4,600 (€9,200 for a couple) on gains, after eight years of the contract, applies to contracts taken out with an insurer in the European Union or the European Economic Area "under the same conditions as for contracts taken out in France." It is granted for all contracts held by the same taxpayer.

What changes

What remains unchanged

The insurer is based in Luxembourg and regulated by the CAA.

The gains are taxable in France

The assets are deposited with a custodian bank, which holds a lien on the inventory.

The tax allowance of €4,600 / €9,200 after eight years, per taxpayer

A dedicated fund (minimum premium of €125,000) or a specialized insurance fund is possible.

The winnings are declared in your French tax return.

Foreign contracts must be declared annually (form 3916 bis)

Your tax residence remains in France.

3. Entrance fees and admission ticket

At Balmont Conseil, entry fees are 0.5 % on Luxembourg life insurance contracts. For example, using a figure chosen for demonstration purposes: 0.5 % of €100,000 invested equals €500. Contract and investment management fees are additional: request these in euros per year, as explained in our article on the cost of a consultant in Lyon.

Regarding the entry fee, there are two official benchmarks: €125,000 for a dedicated fund, and no conditions for a specialized insurance fund (Dedicated fund: from what amount). For other plans, the threshold is included in the insurer's proposal: request it in writing before any appointment.

4. Mandatory declarations of the foreign contract

Individuals residing in France must declare their life insurance policies held with foreign institutions, using form 3916 bis, at the same time as their income tax return. If you file your taxes online, this form must also be completed online. The penalty for an undeclared policy is €1,500 per policy, and €10,000 when the country in question does not have an administrative assistance agreement with France allowing the exchange of banking information. The required information is detailed in our information sheet on [link to relevant page]. form 3916 bis.

For the technician. Declaration obligation for persons domiciled in France within the meaning of Article 4 B of the CGI; penalty of Article 1736 of the CGI (€1,500 per undeclared contract, €10,000 in States without assistance agreement); proceeds from contracts taken out outside France taxable as foreign securities, 6° of Article 120 of the CGI, and allowance extended to insurers of the EU and the EEA by BOI-RPPM-RCM-20-10-20-50 (§ 390 to 410); for Luxembourg, circular letter CAA 16/9 (deposit of securities, inventory and lien) and circular letter CAA 26/1 (dedicated funds and specialized insurance funds).

5. Choose a firm that provides you with written confirmation of its status, level of advice, fees in euros, and a list of required tax returns. If they cannot provide these, do not sign. We are not independent and are paid on commission: we state this clearly, and we ask you to demand the same from everyone.

Frequently asked questions

Is a Luxembourg contract taxed less than a French contract for a resident of Lyon?

No. A French tax resident is taxed in France on the gains, and the tax allowance after eight years applies under the same conditions. What changes is the insurer, the custodian bank, and the obligation to declare the foreign contract.

What are the risks if we forget to declare the contract?

A fine of €1,500 per undeclared contract, and €10,000 if the country does not have an administrative assistance agreement with France.

From what amount can one open a Luxembourg contract?

It depends on the plan. For a dedicated fund, the minimum premium is €125,000. For a specialized insurance fund, there are no premium or wealth requirements. For other plans, ask for the minimum amount specified in the proposal.

Do you have a Luxembourg contract proposal in hand?

Send it to us: the review of your contracts is free, and the initial meeting, in Lyon or via videoconference, will focus on the intermediary's status, their remuneration, and the required declarations.
