It applies criteria in a specific order: permanent home, closest personal and economic ties, habitual residence, nationality, then, as a last resort, amicable agreement between the two administrations. The wording varies from one convention to another: you must read the one that applies to you. Last reviewed: 23/10/2026.

What happens in the event of a tax residency conflict between two countries?

In the event of a dispute, the tax treaty between the two countries designates a single state of residence, applying priority-based tie-breaker criteria. Domestic law is no longer sufficient: the treaties have their own criteria, which take precedence over national rules.

Conflict often arises from overlapping internal rules. In France, you are considered a tax resident as soon as...’only one If one of these three criteria is met (Article 4 B of the French General Tax Code): your household (spouse, children) or, failing that, your principal residence is in France; you carry out your professional activity there, unless it is secondary; and France is the center of your economic interests. Another country may apply its own criteria to you simultaneously. In that case, you are a resident of both countries.

The OECD model convention, which serves as the basis for most French conventions, classifies a natural person in this order:

The permanent residential home : you are a resident of the state where you have a permanent residence.

The closest personal and economic ties (the "center of vital interests"), if you have a home in both states.

The usual stay, if this center cannot be determined or if you have no focus in either of the two.

Nationality, if you usually stay in both states or in neither.

The amicable agreement : if you have both nationalities or neither, the authorities of both States decide by mutual agreement.

The criteria are read in order. We only move on to the next one if the previous one doesn't provide a conclusion. Therefore, having accommodation in France takes precedence over the number of days spent elsewhere.

Each convention has its own wording. The French administration reiterates that the number and content of the criteria vary according to the conventions, and only the applicable convention is authoritative. In the absence of a convention between the two countries, each applies its domestic law, and no treaty can arbitrate the dispute.

If the criteria yield no results, the French administration contacts the other country to initiate a amicable procedure. You do not have to wait for this step to act: the more your situation is documented (housing, family, activity, accounts), the easier it is to establish the qualification.

How does a tax treaty between France and another country work?

A tax treaty is an agreement between two states that allocates the right to tax income and prevents the same income from being taxed twice. Its aim is to eliminate double taxation by the state of your residence.

In practical terms, the convention specifies, for each category of income (wages, pensions, rental income, dividends, interest, capital gains), which state can tax it and up to what limit. The country of residence then corrects the double taxation using one of these methods:

The tax credit equals the tax paid abroad : France credits you with the foreign tax, up to the limit of the French tax on the same income.

The tax credit equal to the French tax : foreign income, if it has been taxed in the other country, is ultimately not taxed in France.

The exemption with effective rate : the income is not taxed in France, but it is taken into account to determine the rate applied to your other income.

The choice of method depends on the tax treaty and the nature of the income. Income from foreign sources is declared on form 2047, attached to the income tax return. If no treaty exists with the country in question, this income is taxable in France.

The list of tax treaties concluded by France is published by the tax authorities, and the text of each treaty can be consulted on impots.gouv.fr. We provide details on some of these treaties on the website, for example, for Quebec, Turkey and Hungary.

Can the tax authorities check my residence after I leave?

Yes. Leaving France does not close the audit period: the reassessment period runs from the tax year, not from the date of your departure.

The standard statute of limitations is three years: the tax authorities can make adjustments until the end of the third year following the year in which the tax is due. For income earned in 2025, this means they have until December 31, 2028. This period is extended to ten years in the event of tax fraud, including undeclared activity or fraudulent maneuvers (until December 31, 2035 for income from 2025).

The period also extends from three to ten years when the obligations to declare assets held abroad have not been met. For foreign accounts, the extension takes effect as soon as the total credit balances exceed €50,000 at any point during the year. Therefore, if you hold accounts or assurance-vie policies outside of France, declaring them determines the duration of your exposure.

In essence, the administration reiterates the criteria of Article 4 B: where your home is, where your main activity is, and where your economic interests are. Only one of these criteria is sufficient to maintain your residency status. It can also conduct a adversarial examination of personal tax situation, This review compares your declared income to your cash flow, assets, and lifestyle. In principle, this review cannot exceed one year. It applies whether or not you are a tax resident of France, as long as you have income tax obligations in France.

Your best protection is a file of evidence compiled at the time of departure and kept up to date: lease or property deed abroad, employment contract, proof of residence, children's school records. We provide details evidence to keep. Simply counting one's days of attendance is not enough either: You can remain a French tax resident even if you spend more than 183 days outside of France..

What we do

Alexis Sagnier, founder of Balmont Conseil (Lyon, for almost 14 years), is a financial investment advisor and member of ANACOFI, an insurance broker, ORIAS registration number 13003497.
