Failure to declare this account incurs a fine of €1,500 per account, €10,000 if the country does not have a tax fraud prevention agreement with France, and up to an additional 80% of the tax due when undeclared funds are recovered.

Our position: we regularize before the letter from the administration, because that is when we choose the form and the timetable of the process.

«"I declared everything when I arrived, except for an old savings account I thought was closed." This situation is common: an account or contract that the taxpayer had forgotten about, or didn't know they had to declare. The oversight is penalized by fines per item; that's why taking inventory is paramount.

1. What the administration receives without asking you for anything

Automatic exchanges between states perform the initial filtering.

Under the European DAC 2 directive and the OECD's Common Reporting Standard (CRS), partner states transmit data on accounts held by their tax residents to the French tax authorities. In 2021, the Ministry indicated that the bank account file (FICOBA) should incorporate this data. An incomplete declaration is therefore detected through cross-referencing, without prior investigation. Banks also ask their clients about their tax residency: see our article on the tax residency required by the bank.

Box 8UU of the online tax return may already be checked when the foreign organization has transmitted your tax details. Furthermore, an account opened with an online bank whose IBAN does not begin with FR is likely a foreign account, even if the interface is in French.

For the technician. Articles 1649 A (accounts), 1649 AA (assurance-vie and capitalization contracts taken out outside France), and 1649 AB (trusts) of the French General Tax Code (CGI) establish the obligation. Law No. 2026-534 of June 25, 2026 (combating social and tax fraud) does not amend Article 1649 A. Article 14 of this law creates Article L. 81 B of the French Tax Procedures Code (LPF): when the tax authorities exercise their right to obtain information from establishments and organizations subject to Article 1649 A, i.e., banks and organizations that declare accounts, they may request an electronic response, in a format set by decree. Article 36 extends the retention period stipulated in Article L. 102 B of the French Tax Procedures Code (LPF) from six to ten years for documents whose retention period expires after January 1, 2027. This article applies to books, registers, documents, and records subject to the right of access, and does not change what account holders must declare. According to economie.gouv.fr, the law also creates a new reporting obligation for trust administrators and strengthens the penalties applicable to undeclared trust assets.

2. Before filing, gather the following information for each account: the account number, type, country, managing institution, and, if applicable, the closing date: these are the details the tax authorities will verify. Form 2086 (cerfa no. 16043) declares capital gains and losses on the sale of digital assets; it does not replace the declaration of digital asset accounts held abroad, which is made using form 3916-3916 bis. Trusts are subject to separate forms, filed by their trustee: 2181-TRUST1 for creation, modification or termination, 2181-TRUST2 for the annual value as of January 1.

3. What remains is the fixed penalty, per account or per contract, and the 80% surcharge on taxes when sums appearing in undeclared accounts are recovered.

For the technician. Article 1736 IV of the French General Tax Code (accounts), Article 1766 (contracts), Article 1729-0 A (increase of 80% of the tax due, which replaces the fixed penalty for the accounts concerned). Constitutional Council decisions no. 2016-554 QPC of July 22, 2016 and no. 2017-667 QPC of October 27, 2017.

4. Regularize before the letter

An omission you discover can be corrected by filing an amended return and submitting the missing forms. For a common error, Service-Public indicates that filing an amended return spontaneously, or responding within 30 days to a reminder from the administration, avoids the 10% penalty; late payment interest of 0.20% per month remains due. The earlier the correction is made, the fewer months of interest will be charged, and the better you can manage the documents.

Case study: three omissions, one year

Situation. A family that returned to France holds two bank accounts abroad. Nothing has been declared for the year.

Issue. Two accounts were omitted before any checks were carried out. What fixed penalty does she face, depending on whether the country of the second account has a tax treaty with France or not?

Strategy. She quantifies both hypotheses before making the adjustments.

Result. If both countries have tax treaties: 2 × €1,500 = €3,000. If the second account is in a country without a tax treaty: €1,500 + €10,000 = €11,500. The €8,500 difference is solely due to the country where the account is held.

Illustrative example, calculated using the rules in effect on October 23, 2026. Assumptions: only one year of omission, one penalty per account, no tax reassessment on income from these assets. An undeclared foreign assurance-vie policy would be added, with its own fixed penalty. If undeclared amounts are recovered, the 80% surcharge on the taxes due replaces the penalty.

Frequently asked questions

Can the authorities find out about my foreign account without me declaring it?

Yes. Partner countries transmit data on their residents' accounts to the government under the DAC 2 directive and the OECD CRS standard. Reconciliation with your tax return is then automatic.

What is the fine for a forgotten foreign bank account?

€1,500 per undeclared account, €10,000 if the account is located in a country without an anti-fraud treaty with France. When funds in undeclared accounts are recovered, an additional 80% of the taxes due replaces the fine.

Does an account closed within the year still need to be declared?

Yes, in principle. The obligation covers accounts opened, held, used at least once, or closed during the tax year. An account closed during the year must be declared using its closing date when you were a tax resident in France at some point during that year; the case of an account closed before the date of your return will be verified on file.

Have you just returned and have a question about an account or a contract?

The first interview takes stock of your accounts and contracts abroad, verifies what has been declared and calculates the cost of regularization.

Are you a notary, chartered accountant, lawyer, or fellow consultant? And your client returns with assets abroad?
